REGULATION CONCERNING THE ORGANIZATION AND FUNCTIONING OF THE
Chapter 1. General Dispositions Art. 1. THE CSÁNGÓ ETHNOGRAPHICAL MUSEUM is a public cultural institution, being a department of the Sekler National Museum from Sfântu Gheorghe. All the movable and immovable patrimony of the Csángó Ethnographical Museum is the property of ASOCIAȚIA PRO MUSEUM EGYESULET ZĂBALA/ZABOLA. Art. 2. THE CSÁNGÓ ETHNOGRAPHICAL MUSEUM is organized and is functioning in conformity with the rules of this present Regulation Concerning Organization and Functioning as well as with Law nr. 311/2003 concerning museums and public collections. Art. 3. a) The official name of the institution is MUZEUL ETNOGRAFIC CEANGĂIESC - CSÁNGÓ NÉPRAJZI MÚZEUM (used in the following as "METC"). b) The seat of METC is in Zăbala, Gării Street Nr. 789, Covasna County. c) METC has its own round seal with the following content: Muzeul Național Secuiesc Secția Muzeul Etnografic Ceangăiesc Zăbala - Székely Nemzeti Múzeum Csángó Néprajzi Múzeuma Zabola. d) The letterhead of the documents and correspondence of METC will have the same contents as the seal with the mentioning of the address.
Chapter 2. Specific Competency and Activities Art. 4. METC is a cultural and scientific institution of public right. METC fulfils its own museal, cultural and scientific mission by fulfiling certain competencies and by multiple specific activities regarding the collection, conservation, restoration, protection, evidence, research, evaluation and realization of goods of national, regional and local cultural patrimony. These competencies and activities are summed up by the following basic functions of METC: 1. The function of conservation including: a) The administration of the collections by the conservation, restauration, depositing, evidence and security of the patrimony of METC. b) The purchasing of further patrimonial goods by collecting and research actions as well as by buying and receiving donations. 2. The function of exploration including: a) Research programmes of our own, b) Research programmes together with other museal, cultural or educational institutions, as defined in research protocols. 3. The function of information including: a) The organization of permanent, temporary and itinerant exhibitions of our own or together with others, respectively hosting itinerant exhibitions and presenting demonstrative programmes, b) The publishing of articles, books of scientific, cultural or propagating nature, the publishing of scientific periodicals, leaflets etc. c) The editing of scientific, cultural or propagation multimedia material, respectively CD-Rom, VHS or other digital materials as well as an own web page, d) The organization of scientific sessions and conferences. 4. The function of education and propagation including: a) The organization of programmes together with educational institutions, b) The organization of METC's public services by using the methodology of museal pedagogy, c) The organization of programmes aiming the education of the public at large: lectures, documentaries, concerts, cultural shows, book launch, cultural contests etc. 5. The function of integration including: a) To liaise with other regional, national and international museums and institutions, b) To set up relations of partnership with some museums by signing frame accords, c) Gaining a membership in the specific local, regional, national and international organizations, d) Participating in scientific and cultural events in the country and abroad.
Chapter 3. Competency Art. 5. To succeed in its objects METC undertakes the following competencies: a) to carry out studies, fieldwork, archive reserach in Zăbala, in Covasna County or in other regions, b) to purchase different cultural and scientific goods by buying, collecting, fieldwork or by receiving donations, c) to carry out studies and research in collections, museums, archives, libraries, scientific and cultural institutions in the country and abroad, d) to carry out - on demand - professonal expertise regarding cultural and scientific goods based on a contract, e) to offer professional consulting and assistance, f) to make exchange of publications and exhibitions with other national or international cultural or scientific institutions, respecting the legislation in effect, g) to organize scientific and cultural events, manifestations, research camps and workshops, creation camps of a local, regional, national and international interest, h) to facilitate the participation of the staff in specialization strategies, lab research and fieldwork, conferences, research camps and workshops in the country and abroad, i) to carry out the marketing of publications of our own, of other institutions or products of individual creators within our own selling stands, respecting the legislation in effect, j) to propose - based on research programmes of our own or carried out with others and in accordance with the law - new objectives and pieces to be included on the list of reservations, monuments or goods of cultural patrimony and to follow their state of conservation, k) to found publishing houses, bookstores, shops, clubs, labs - respecting the legislation in effect.
Chapter 4. The structure of METC Art. 6. 1) METC is a part of the organizational structure of the Sekler National Museum of Sfântu Gheorghe. 2) The organizational structure of METC, respectively the number of personnel, included in the organizational form and the function statutes, is approved by the Covasna County Council at the proposal of the director of the Sekler National Museum and the president of Pro Museum Society, with the license of the Administrative Council of the Sekler National Museum. Art. 7. METC is an external department of the Sekler National Museum.
Chapter 5. METC management and personnel Art. 8. The management of METC is assured by the Administrative Council, a deliberative management board, and by the director of the Sekler National Museum, being the executive leader of the institution. The Scientific Council is a board with a consultative role. Art. 9. The Administrative Council is formed by the director, as president, by the heads of the internal and external departments, by the president of the Scientific Council, by the financial sub-manager, by one representative assigned by the Covasna County Council and one representative of the employees. Art. 10. The functioning of the Administrative Council 1. The Administrative Council meets in every trimester. 2. Besides the ordinary meetings, the Administrative Council can meet within emergency meeting whenever needed. 3. The ordinary and emergency meetings of the Administrative Council are convoked and organized by the director of the Sekler National Museum. The emergency meetings can be convoked either by the initiative of the director or of the half plus one member of the Administrative Council. 4.The necessary rate for the functioning of the Administrative Council is half plus one of the total number of members. 5. The decisions of the Administrative Council are taken by two thirds of the total number of members being present, with the condition of the necessary rate. Art. 11. The Administrative Council shows the following competencies: a) it debates and exposes an opinion on the Annual Report, b) it analyzes and exposes an opinion on the organizing and functioning regulation, staff, functions, budget, presenting all these to the Covasna County Council for approval. c) it debates and approves the Annual Activity Programme, respectively the Medium Term Activity Programme (research, exhibitions), taking into consideration the proposals of the Scientific Council. d) it initiates the organization of studies, surveys, inquiries regarding the content and evidence of the institute's activity, naming the necessary measures, e) it analyzes and approves the measures of specialization and promoting of personnel, proposed by the director of the institution, f) it analyzes and approves any kind of proposals, memos and materials received from the employees regarding the general administration and functioning of the museum, g) it analyzes the administration of all goods (immovable, patrimony etc.) of the museum, h) at the demand of the director and the members of the Administrative Council offers consulting in any problems regarding institutional activity, i) at the proposal of the director approves the Interior Regulation of the Sekler National Museum. Art. 13. The functioning of the Scientific Council: 1. the activity of the Scientific Council is led and coordinated by a president, 2. the necessary rate for the functioning of the Scientific Council is half plus one of the total number of members, 3. the Decisions of the Scientific Councils are taken by a simple majority of the number of members present, with the condition of assuring the necessary rate, 4. the Decisions of the Scientific Council have the nature of proposals, headed to be analyzed by the Administrative Council. Art. 14. The competencies of the Scientific Council are the following: a) it elects a president from its own members, b) it proposes research topics, directions and programmes, c) it executes scientific control upon research activities, d) it analyzes the research papers carried out by the specialists of the museum, by other cooperating specialists and those realized through given contracts, e) it proposes cooperation and scientific exchange, f) it has the competency of a publishing council, g) it analyzes and proposes the ways of realization of the results of scientific research to the Administrative Council, h) the Scientific Council gathers convoked by the director of the institution or of its own president, i) the competencies of the Scientific Council can be periodically revised according to the present priorities of the institution, j) the Scientific Council can also elect a honorary president. Art. 15. The management structure of the Museum: 1. The executive management of the Csángó Ethnographical Museum is assured by the director of the Sekler National Museum, being named through competition by the Covasna County Council based on a management contract. 2. The director is the secondary administrator of credits, representing the institution in the relation with other institutions, with the local and central public authorities, with NGO, with other legal entities, persons, and in court. 3. In the absence of the director, the financial manager can be named as replacement based on delegation by the director. Art. 16. The director coordinates the following activities: a) legislation, b) personnel, wages, specialization, c) elaboration and proposal of applying of institutional development strategies, d) secretariat, protocol e) the external department from Zăbala. Art. 17. The director has the following competencies and responsabilities: a) to compile the Annual Activity Report, sending it to be controlled by the Administrative Council and approved by the Covasna County Council. b) to engage the museum by his/her signature in the relations with others, in the limits applied by the normative acts in effect, c) to employ - according to the present needs and in conformity with the law - the personnel of the Csángó Ethnographical Museum, including the specialist as well as the administrative or auxiliary staff, d) to name and revoke the head of the external department of the Csángó Ethnographical Museum from Zăbala, e) to be in charge of the Museum's institutional development strategy, presenting it for debate and approval to the Administrative Council, f) to edit the internal regulation, presenting it to the approval of the Administrative Council, g) to compile and present together with the financial sub-manager the budget of expenses and incomes for approval to the Administrative Council, h) to be in charge of compiling the synthesizing materials regarding the coordinated activities, presenting them for discussion to the Scientific Council or the Administrative Council, i) to set out an annual and medium term editorial plan, j) to establish and assure permanent relations with national and international institutes of research, of education, museums, scientific organizations and fora, k) to coordinate the activity of the departments of scientific research and patrimony evidence, l) to be in charge of the elaboration of the scientific research programme, presenting it for approval to the Administrative Council or in case to the Scientific Council, m) to reward or to sanction - in conformity with the law - the personnel from own initiative or at the proposal of the heads of department, n) to approve the financial and accountancy documents that need his/her signature, in conformity with the law, o) to approve the holidays of the personnel, according to the annual plan, p) to assign the working commissions through dispositions, q) to approve or reject - in conformity with the law - the employment of the personnel by other employers, if a part of the programme within the second function matches with the function held in the Museum, r) to be in charge of the Museum's activity and the fulfillment of its own management programme in front of the Covasna County Council, s) to take any other measures by emitting dispositions - in conformity with the law - considered necessary for a better general or specific activity of the Museum, t) to overtake any other competencies and responsibilities that would assure a better functioning of the department from Zăbala. Art. 18. The head of department of the Csángó Ethnographical Museum has the following competencies: a) he/she is proposed and elected by the Administrative Council of the Sekler National Museum, with the approval of the Pro Museum Association Zăbala, b) to elaborate the development strategy of the department, presenting it for approval to the Administrative Council, c) to elaborate the plan of scientific research, presenting it for approval to the Scientific Council of the Sekler National Museum, d) to coordinate the evidence of the department's patrimony e) to be in charge of the administration, purchase and restauration of the patrimonial goods of the department, f) to be in charge of the permanent, temporary and traveling expositions of the department, g) to be in charge of the scientific, professional contracts and co-operations with other professional institutions, h) to organize scientific and cultural manifestations, seminars, camps, workshops, i) to coordinate the department's own publications, j) to participate at the meetings of the Administrative Council of the Sekler National Museum, k) to compile an annual report on the activity of the department, presenting it for approval to the Administrative Council, l) to assure an adequate communication between Pro Museum Association and the Sekler National Museum. Art. 19. The personnel of the Csángó Ethnographical Museum is lead by the head of the department, and it is formed by specialists (museologist, ethnographer, researcher, restaurator) and by auxiliary and administrative personnel.
Chapter 6. Material base, patrimony, financing Art. 20. The patrimony of METC is formed by the rights and obligations over the goods being the property of Pro Museum Association Zăbala, administrated in conformity with the law, and over the private possessions of the institution. Art. 21. METC has under its own administration immovable goods, the property of Pro Museum Association Zăbala, with functioning offices, library, exhibition halls, depository, a farmer's house within, plus open air spaces. Art. 22. METC has a museal patrimony organized by collections, including cultural and scientific goods from the domains of popular material culture, history, archive and library - with METC holding the rights over their administration as well as the copyright with the additional regulations of the law. the museal patrimony of METC is unitary, undividable, inalienable and inconceivable. Art. 23. The scientific data base of METC is formed by a library and scientific archive, containing audio-visual material, photographs, manuscripts, CD-s etc. Art. 24. For its own specific activity METC holds movable goods (e.g. telephone, fax, TV, PC-s etc.) necessary for study, research, conservation and restauration, stocking and multiplication, respectively security alarm, fire alarm and so on. Art. 25. METC finances itslef from its own incomes, from allocations from the budget of Covasna County Council, of Zăbala Local Council, of Pro Museum Association and from national and international grants.
Chapter 7. Final dispositions Art. 26. The duties and obligations of the personnel, the working and visiting hours, the interdictions, rewards and sanctions are included in the Interior Regulation of the Sekler National Museum, the Csángó Ethnographical Museum Zăbala being a part of the structure of this institution. Art. 27. This present regulation is in force after it is being approved by the Administrative Council of the Sekler National Museum and after the accreditation of the department from Zăbala.
